ABX Apps develops and operates Community Exchange. These Terms are linked from the app and paywalls as https://abx-apps.com/terms.
These Terms govern your use of the Community Exchange iOS application operated by ABX Apps and related services for this product. By creating an account, tapping Sign in with Apple, or using the app, you agree to these Terms and our Privacy Policy.
The Community Exchange iOS app is licensed, not sold. The app binary is also subject to Apple’s Licensed Application End User License Agreement (the Standard EULA). These Terms are the service agreement for using Community Exchange. They are not a custom App Store EULA.
This page is only for Community Exchange.
1. The service
Community Exchange is a peer-to-peer tool for discovering listings, visiting peer storefronts, negotiating exchanges (including over live video/audio), sealing promissory notes, and optional Neighbors updates.
- We provide communication and organization tools, not escrow, payment processing for trades, or guarantees that a trade will complete.
- Trades, goods, skills, and services are between users.
- Optional digital features (hosted LiveKit plans, listing packs, banner credits) are sold only via Apple In-App Purchase.
- Banner credits are consumable in-app promotional credits for featuring your store or listings inside Community Exchange. They are not third-party advertising.
2. Eligibility (18+)
You must be at least 18 years old and able to form a binding contract. The app may use Apple’s Declared Age Range and parental-control signals and may restrict access for minors or when communication limits apply.
3. Accounts
- Authentication is via Sign in with Apple. There is no app password.
- You are responsible for activity under your account and for keeping device access secure.
- You may delete your account in-app (Account → Delete Account & Data).
- Guest browsing of public marketplace content may be available without an account; trading features require a signed-in account and store setup.
4. User-generated content and conduct
You are solely responsible for content you post or transmit, including listings, photos, videos, Neighbors posts, bulletins, profile text, and live communications.
4.1 You agree not to
- Post illegal, fraudulent, deceptive, or harmful content.
- Harass, threaten, stalk, or abuse others.
- Share sexual content involving minors, or non-consensual intimate imagery.
- Promote hate, violence, or terrorism.
- Impersonate others or misrepresent goods or services.
- Spam, scrape, or disrupt the service.
- Use the app for commercial advertising that violates these Terms or App Store rules outside permitted in-app promotional products (banner credits).
- Attempt to reverse engineer, abuse rate limits, or circumvent billing or safety controls.
4.2 License you grant us
You retain ownership of your content. You grant ABX Apps a worldwide, non-exclusive, royalty-free license to host, transmit, display, and process your content solely to operate and improve the service (including moderation and multi-device sync).
4.3 License you grant other users
When you publish listings, storefront content, or Neighbors posts, you allow other users to view and interact with that content as the product features allow.
4.4 Moderation
We may remove content, suspend features, or terminate accounts for violations. Users can report content and block other users in-app. We aim to review reports promptly (target: within 24 hours under normal operations). Enforcement may include removal of content and bans of repeat offenders.
4.5 No comments on Neighbors posts
Neighbors/Activity is designed without comments or replies; misuse via other channels remains subject to these Terms.
5. Peer trades and disclaimers
- You are responsible for the legality, safety, and quality of what you offer or accept.
- Meet-ups and handoffs are at your own risk; use common-sense safety practices.
- The app does not provide payment escrow for barter deals.
- Promissory notes and ratings are organizational tools between peers; they are not legal advice.
- Video calls, store rooms, and streams are live only. We do not record them and we do not store call or stream media. Hosted video rooms depend on network conditions and third-party infrastructure (LiveKit).
6. Subscriptions and digital purchases
- Prices are shown in the app via Apple and may vary by region.
- Auto-renewable subscriptions (hosted LiveKit plans) renew unless canceled in Apple ID settings at least 24 hours before the end of the period. Manage or cancel in iOS Settings → Apple ID → Subscriptions.
- Listing packs and banner credits are consumable one-time purchases and do not auto-renew.
- Annual pricing that “saves 2 months” is a discounted annual price, not a free trial, unless a free trial is explicitly labeled by Apple.
- Restore purchases re-links entitlements for the Apple ID on the device. Restore is available on paywall and hosting screens.
- Refunds are handled under Apple’s policies.
7. Self-hosted LiveKit
If you choose the manual LiveKit path, you supply your own LiveKit Cloud project credentials. You are responsible for compliance, cost, and security of that project. Do not share API secrets publicly.
A/V is live only. We do not record calls or streams and we do not store call or stream media on our side.
8. Intellectual property
The app, branding, and software (excluding your content and third-party components) are owned by ABX Apps or its licensors. You may not copy or redistribute the app except as allowed by the App Store license.
9. Third-party services
The service depends on Apple, Supabase, LiveKit, and other processors described in the Privacy Policy. Their terms and privacy practices apply to their processing. You must also comply with applicable third-party terms (including your wireless data agreement) when using calls, streams, or other data-heavy features.
The Licensed Application license is between you and ABX Apps, not Apple. ABX Apps, not Apple, is responsible for the app and for maintenance and support (support@abx-apps.com). Apple has no obligation to furnish support. Apple and Apple’s subsidiaries are third-party beneficiaries of the Standard EULA.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT PEERS WILL COMPLETE TRADES.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABX APPS AND ITS OPERATORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR FROM PEER TRANSACTIONS. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US FOR DIGITAL FEATURES IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50, EXCEPT WHERE PROHIBITED.
12. Indemnity
You agree to defend and indemnify ABX Apps against claims arising from your content, trades, or violation of these Terms, to the extent permitted by law.
13. Termination
You may stop using the app and delete your account. We may suspend or terminate access for violations, risk, or legal reasons. Sections that by nature should survive (disclaimers, liability limits, IP, indemnity) survive termination.
14. Changes
We may update these Terms. Continued use after the effective date of changes constitutes acceptance. Material changes may be highlighted in-app or on abx-apps.com when practical.
15. Governing law
Except where mandatory consumer law in your country provides otherwise, these Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. Venue for disputes will be courts located in California with jurisdiction over the dispute, subject to your non-waivable rights.
